TERMS OF USE

Dear customers, please read the following conditions carefully before ordering our products. With every purchase on our site, it means that you have read the conditions and that you agree with them in full.

The place of delivery of the ordered goods must be located on the territory of the Republic of Serbia.

It is not possible to pay for goods by cash on delivery. An advance payment of at least 70% of the total value of the goods is considered an order confirmation.

The seller is obliged to ensure that the goods are delivered to the buyer as soon as possible by his own delivery vehicle or via a courier service, and in case of inability to send the goods for any reason, he is obliged to inform the buyer about this within seven days.

The buyer can, within the legal term of 14 days after receipt, return the ordered goods to the seller without any explanation. The seller is obliged, in that case, to return the entire amount paid to the buyer, except for the cost of delivery of the goods.

The product can be exchanged within 14 days from the day of purchase, i.e. with the receipt and the original packaging of the product. The cost of replacement and such return shall be borne by the Buyer. In order to exercise any of your rights when returning the purchased product, the ordered goods must not be damaged or worn due to use, they must be returned in the original packaging, with the invoice attached.

The original packaging must not be worn or damaged in any other way, because in this case the right to a full refund is not recognized, but the costs of the damaged packaging are deducted from the total amount refunded.

Cameleon Home Art undertakes to store contracted and undelivered goods no later than 30 days from the date of scheduled delivery. After that period, it is not possible to guarantee the quantitative and qualitative correctness of the goods. In case of cancellation of the ordered goods, Cameleon Home Art retains 40% of the ordered value.

Cameleon Home Art guarantees the quality and originality of the goods it delivers.

In the event that the Buyer makes a payment of an amount that is less than the amount stated in the pro-invoice, it will be considered that the sale has not been concluded.

Delivery costs for shipments that can be transported by courier service amount to 300 dinars.

For products that, due to their physical properties, cannot be transported by courier service (fragile, bulky, there is an increased risk of defects during improper transport), such as sanitary ware, tiles, bathtubs, mosaics, etc. transport is carried out by a specialized carrier and the delivery price is subsequently formed by a separate transport contract. The cost of delivery depends on the distance, weight, and dimensions of the product.

The goods are delivered to the Buyer personally or to the person indicated by the Buyer as the recipient of the shipment. The buyer or recipient of the shipment must be at the address specified in the purchase order for the delivery of the goods between 9 a.m. and 5 p.m., on weekdays and Saturdays.

If the delivery of the ordered goods is prevented due to the absence of the Buyer or another person provided for in these Terms and if the goods have to be returned to the place of origin, the Buyer will be obliged to bear the costs of returning the goods. The Seller can sell the returned goods to third parties because at that moment the sale is considered terminated.

When picking up the package, the Customer visually checks the package in the presence of the courier or postman.

If there is visible damage on the package in the form of torn parts or bruises, the Buyer is obliged to request the opening of the package in the presence of an official. If on that occasion it is established that the articles are damaged, the employee of the courier service makes a record of the complaint.

In case of damage to the contents of the package, the courier service reimburses the incurred costs.

You can pay for the products you ordered and want to buy through the cmlhome.rs website in two ways:

– By cash payment at CML HOME ART salon, Hadžićeva 112, 18360 Svrljig
– Payment cards, payment to account 160-255775-21

Note: In case of payment by payment card, your funds will be reserved until the order is confirmed or canceled by the internet sales operator.

The last step of ordering: By clicking on the “ORDER” button, you will receive an automatic e-mail message informing you that your order has been successfully forwarded to the internet sales service for further processing. The Seller’s online sales service will try to check as soon as possible whether we are able to provide you with the ordered item(s) and what is the delivery date if the ordered products are currently not in stock.

If we are unable to provide you with certain products from several products contained in your order, our internet sales operator will call you and inform you which of the ordered products are not available, and your consent will be requested to deliver only those products that you have ordered, while we have them available in stock. We strive to keep the inventory on the website up-to-date, but due to dynamic sales, there is a possibility that in certain cases the ordered product will no longer be available in our warehouse.

In the event that, after the order has been placed, it is determined that the wrong price has been marked on the website by mistake in relation to the ordered model (for example, instead of 1000 dinars, the price is 100 dinars), the Seller will endeavor to inform the Buyer as soon as possible about the observed error and the exact amount of the price that was valid for the ordered product at the time of instruction. In that case, the Customer has the right to pay for the ordered product according to the correct retail price or to cancel the order.

Note: The prices on the website are only valid for purchases through the website and they may differ from the prices in the CML HOME ART showroom, so it is necessary to consult the Sellers about the prices, conditions and delivery terms for specific products.

2.1.3. Statement of Conversion

All payments will be effected in Serbian currency – dinar (RSD). The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Serbian dinar according to the current exchange rate of the Serbian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site

2.1.5. Delivery of Goods and Possible Restrictions

Products ordered on the website info@cmlhome.rs are delivered by the Postexpress courier service on the territory of the Republic of Serbia. If the product is of larger dimensions, and the courier service cannot deliver, we hire our own vehicle and agree the details of the delivery with the client. Delivery by courier service Postexpress as well as by our vehicle is FREE. The delivery time for goods purchased in the online store is 2 to 5 working days from the registration of the payment for the goods from the warehouse.

If we currently do not have the requested product in stock, we can produce it within a maximum of 30 days with the additional option for the customer to choose the material / color. For goods that are specially ordered, the Seller will contact the Buyer and inform him about the expected arrival of the goods and the expected date of availability of the goods. Due to the increased volume of orders during seasonal discounts, the delivery time may be extended up to 7 working days. The term starts when the payment is confirmed by the online store or on the first working day after the order is submitted.

2.1.6. Complaint Policy

With this rulebook, the trader regulates the manner, conditions and procedure for resolving consumer complaints (complaints) due to the non-conformity of the goods via the cmlhome.rs website and the trader’s powers, obligations and responsibilities regarding exercising the consumer’s right to complain.

A consumer, in the sense of this rulebook, is any citizen who makes a purchase via the Internet on the site cmlhome.rs.

The consumer has the right to complain about the purchased product within two years from the date of purchase.

The consumer can file a complaint on goods purchased from the Seller in one of the following ways:
• By physically coming to the salesroom: verbally declaring a complaint, submitting a written submission and submitting a written submission on a permanent record carrier (CD),
• By letter, to the address of the Seller at Hadžićeva 112, 18360 Svrljig, with the indication: For the complaints service

When submitting a complaint request, the consumer is obliged to:
a. Submit the advertised article together with the proof of purchase – the receipt.
b. Submit a completed complaint form.
c. In the complaint form, it is necessary to state the reason for the complaint and the desired method of resolution.

The merits of the complaint request are determined by the competent commission. The response to the reported complaint will be sent to the Consumer in the shortest possible time, which cannot be longer than 8 days. The deadline for resolving complaints cannot be longer than 15 days, or 30 days for technical goods.

In the case of a well-founded complaint and its acceptance by the merchant, the Consumer has the right, at his own choice, to:
a. Exchange of the purchased product with a defect for a new, correct product or removal of defects on the product if this is possible
b. Refunds of the amount paid according to the attached invoice, in the case when the elimination of non-conformity is not possible. The refund to the Consumer will be made electronically to the Consumer’s current account within 15 days from the day of the complaint.

2.1.7. User Privacy Protection

On behalf of Cameleon Home Art, we are committed to protecting the privacy of all our customers. We collect only the necessary, basic information about customers/users and the data required for business operations and informing users, in accordance with good business practices and with the aim of providing quality service. We offer customers the option to choose, including the ability to decide whether or not they wish to be removed from mailing lists used for marketing campaigns. All customer/user data is strictly protected and accessible only to employees who need it to perform their job. All employees of Cameleon Home Art (and business partners) are responsible for adhering to privacy protection principles.

2.1.8. Protection of confidential transaction data

When entering payment card data, confidential information is transmitted via public network in a protected (encrypted) form using SSL protocol and PKI system, as currently
state-of-the-art cryptographic technologies. Data security during purchases is guaranteed by the payment card processor, Banca Intesa ad Belgrade, so the complete billing process is done on the bank’s website. Not even one payment card information is currently not available to our system.

2.1.9. Refund

In the case of returning goods and refunding funds to a buyer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, Cameleon Home Art is obliged to make the refund exclusively via VISA, EC/MC, Maestro, Amex and Dina payment methods. This means that the bank will, at the seller’s request, process the refund to the cardholder’s account.
